These Terms of Service ("Terms") govern your use of all products and services ("Services") offered by Picsolv. Please read these Terms carefully before using the Services. By continuing to use the Services, you acknowledge that you have read, understood and agree to these Terms.
Picsolv is committed to acting in accordance with applicable law, in particular personal data protection and the Turkish Personal Data Protection Law (KVKK). You agree to comply with the same obligations when using the Services.
2.1. Picsolv provides the technical infrastructure for uploading, storing, matching event photos with face recognition technologies and delivering them to participants.
2.2. The scope of the Services may be updated over time; new modules may be added or some modules may be discontinued.
2.3. You agree to use the Services only in compliance with applicable law, these Terms and principles of good faith. You may not use the platform for any illegal, offensive, defamatory purpose or in any way that infringes the rights of third parties.
2.4. You are responsible for all activities under your account. You are responsible for keeping your login credentials confidential.
3.1. You represent and warrant that all content you upload to the platform (photos, videos, text, etc.) does not infringe the personality rights, trademarks, copyrights or any other rights of third parties.
3.2. If you are an event organiser, you are responsible for informing participants in accordance with applicable law that photos will be uploaded to the platform, stored and may be matched using face recognition technology.
3.3. You may not use the platform in any way for spam, distribution of malicious software, unauthorised access to systems or similar illegal activities.
3.4. Picsolv reserves the right to remove or restrict access to content that is found to be or suspected of being illegal, without prior notice.
4.1. You may need to create a user account to fully benefit from the Services. You are responsible for providing accurate, complete and up-to-date information during registration.
4.2. You are responsible for all activities related to your account. If you believe your password has been used by unauthorised persons, you must contact Picsolv immediately.
4.3. Picsolv reserves the right to suspend, terminate or restrict your account temporarily or permanently in case of breach of these Terms, security risk or suspicion of illegal activity.
4.4. You may request termination of your account at any time; however, certain data may need to be retained as required by applicable law.
5.1. The Picsolv platform, software components, design elements, logo, brand, domain name and all related elements are subject to the intellectual property rights of Picsolv or its licensors. These elements may not be copied, reproduced, distributed or used to create derivative works without prior written permission.
5.2. Copyright in the photos and other content you upload to the platform belongs to you or the relevant rights holders. Picsolv may process, store and reproduce this content as necessary to provide the Services, maintain backups, ensure security and fulfil legal obligations.
5.3. Picsolv may use anonymised data that does not contain personal data for improving service quality, product development and analysis indefinitely.
6.1. Details regarding the processing of your personal data and in particular your biometric data (face recognition data) are set out in the Privacy Notice, Explicit Consent Form and Privacy Policy. These Terms form a whole together with those documents.
6.2. By continuing to use the Services, you confirm that you have read the relevant notice and consent texts, that you have been informed about your rights regarding data processing and that you have given your consent where required.
6.3. Under KVKK and related legislation, you may contact Picsolv through the channels set out in the Privacy Policy to exercise your rights such as access, rectification, erasure, restriction of processing, objection and data portability.
7.1. Picsolv may change, update, add new features to or discontinue all or part of the Services at any time. Such changes will be communicated to users in advance or within a reasonable period where possible.
7.2. Access to the Services may be temporarily interrupted due to mandatory maintenance, force majeure, infrastructure or supplier issues. Picsolv does not guarantee that the Services will always be uninterrupted despite reasonable efforts.
7.3. Significant changes and updates to the Services may be communicated to you via the website, in-app notifications or your registered contact details.
8.1. Picsolv provides the Services "as is" and "as available"; it gives no express or implied warranty as to fitness for a particular purpose, uninterrupted operation or freedom from defects.
8.2. To the maximum extent permitted by law, Picsolv is not liable for indirect, incidental, special, punitive or consequential damages, including loss of profit, data loss or business interruption.
8.3. Even where Picsolv is directly liable, its total liability is limited to the total amount you have paid for the Services in relation to the transaction that caused the damage (in cases of free use, the legally mandatory minimum limits apply).
9.1. The platform may contain links to third-party services, websites or applications. These links are provided for convenience only and Picsolv is not responsible for the content or practices of such third parties.
9.2. If you use third-party services, the terms of use and privacy policies of the relevant provider will apply.
10.1. Picsolv may update or amend these Terms from time to time. The updated text will be effective from the date it is published on the platform.
10.2. When material changes are made, reasonable notice will be given (e.g. via in-app notification or email). Your continued use of the Services constitutes acceptance of the updated Terms.
11.1. These Terms are governed by and construed in accordance with the laws of the Republic of Turkey.
11.2. In the resolution of any dispute between the parties, amicable solutions shall be sought first; failing that, the courts and enforcement offices of Istanbul (Anatolia) (or the courts of the place where the company is headquartered) shall have jurisdiction.
